Kosovo: Between Law and Morality

EDITOR'S INTRODUCTION | In this lecture, Justice Richard Goldstone explores the often paradoxical relationship between law and morality. He argues that the 1999 military intervention in Kosovo woefully exposed the gap between international law in relation to humanitarian intervention and the moral and political justification of such intervention. Although lawyers performed legal gymnastics in an attempt to find legal justification for NATO's intervention, it still contravened international law. Goldstone considers the circumstances in which intervention may be "illegal" but politically and morally justified.
